The objective and subjective considerations led to AG's detention, according to Kombes Pol Hengki Haryadi, Director of the General Crime Investigation Division (Ditreskrimum) of the Jakarta Metropolitan Police.
"If that is the objective, the sentence is above 5 years," said Hengki in a press conference at Polda Metro Jaya, South Jakarta, Wednesday, March 8, 2023, as quoted from Antara.
According to Hengki, the objective consideration is based on the potential punishment of more than five years, while the subjective reason is to prevent the suspect from fleeing, destroying evidence, and repeating the offense.
As for AG's case, who is a child in conflict with the law, Hengki has special considerations due to her need for support and guidance, especially since her parents are currently ill.
"So there is also special consideration for AG as a child who is in conflict with the law, he needs assistance and so on, it just so happens that his parents are sick," said Hengki.
Previously, AG was detained for her involvement in the assault case against D in Pesanggrahan, South Jakarta.
Prior to her arrest and detention, AG underwent questioning for approximately six hours, and the police decided to take action after considering the evidence and witness testimony.
"Based on the results of our investigation for approximately six hours, tonight we decided to make an arrest and detention," he said.
Furthermore, AG's legal status was changed from a child in legal conflict to a child in conflict with the law by the Jakarta Metropolitan Police.
"There has been a change in status from AG, which initially was a child in conflict with the law, has increased to a child in conflict with the law," said Director of the General Criminal Investigation Unit (Dirreskrimum) Polda Metro Jaya Kombes Pol Hengki Haryadi in a press conference held, Thursday, March 2, 2023.
This decision was made because AG provided false testimony in the assault case against D, as confirmed by CCTV footage and WhatsApp chat records.
"After adjusting to CCTV, WhatsApp chat, all their roles are illustrated so that there is an increase in AG's status, from a child who is before the law to a child who is in conflict with the law or the perpetrator," said Hengki.
However, AG has not been classified as a suspect since she is still a minor. Instead, she is being charged under several articles of the Child Protection Act and the Criminal Code.
The Jakarta Metropolitan Police also previously questioned AG, who is the girlfriend of Mario Dandy Satriyo, a suspect in the assault case against D.***
